Guide to Cat Control Laws

The trend by local councils throughout Australia towards tighter controls on cat populations continues to grow.

Some have proposed the compulsory registration and sterilisation of cats.

In Darwin, By-Laws introduced last year require cats to be properly contained in the owners’ property, under effective control by the owner, and on a lead or enclosed in a suitable container when away from their home. Stiff fines apply if a cat is captured while ‘at large’.

Increasing numbers of local governments around the country are imposing night-time curfews to minimise neighbourhood nuisance issues and protect native wildlife.

This legislative response is being driven by a groundswell of public opinion that cat overpopulation poses a serious threat not only to the environment but to human health.

Domestic (Feral and Nuisance) Animals Act 1994

All cats and dogs over three months of age must be registered.

They must be identified with a tag when outside their owner’s premises.

Councils have also been given the power to require compulsory microchips for all cats and dogs in their municipality.

Cats and dogs sold or given away from any pet shop, breeder or pound must have a microchip and be desexed.

Councils have the power to require compulsory desexing of cats and dogs.

New South Wales Companion Animals Act 1998 Cat and dog owners must microchip their animals and register them with their council.

A reduced fee for registration is offered for desexed animals.

Domestic Animals Act 2000 It is compulsory to register dogs over eight weeks of age but not compulsory for cats.

All cat owners must identify their animals either by microchip, collar and tag, tattoo or a combination of all three.

It is compulsory to desex cats and dogs unless a permit is obtained.

South Australia Dog and Cat Management Act 1995 The Dog and Cat Management Board oversees powers and functions for councils to manage dogs and cats.

All dogs and cats sold from a pound or refuge must be desexed and registered.

Tasmania Tasmania does not have cat registration. The government late last year released a Position Paper containing wide-ranging initiatives in Cat Management.
Northern Territory No Territory-wide animal management legilation in place. Some councils have taken their own initiatives. See Below.
Western Australia There is no Statewide control of cats. Again, many councils have introduced their own management initiatives.
